Terms and Conditions

 

These Terms and Conditions ("Terms") govern your use of BRICK ("the App"). By downloading, installing, or using the App, you agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, you may not use the App.

 

1. Use of the App

1.1. The App is provided for your personal, non-commercial use only. You may not use the App for any illegal or unauthorized purpose.

1.2. You must be at least 13 years old to use the App. By using the App, you represent and warrant that you are at least 13 years old.

 

2. User Accounts

2.1. In order to use certain features of the App, you may be required to create a user account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2.2. You may only create one user account. You may not create multiple accounts for any reason.

 

3. User Content

3.1. The App allows you to create, upload, post, display, or transmit content, including but not limited to text, images, and videos ("User Content"). You retain ownership of any User Content you create, upload, or transmit through the App.

3.2. You are solely responsible for the User Content you create, upload, or transmit through the App. You agree not to create, upload, or transmit any User Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, or otherwise objectionable.

 

4. Privacy

4.1. The App may collect and store information about your location and other information as described in our Privacy Policy. By using the App, you consent to the collection and use of your information as described in our Privacy Policy.

4.2. You may delete all information associated with your account at any time by following the instructions provided in the App.

 

5. Intellectual Property

5.1. The App and its original content, features, and functionality are owned by [Your Company Name] and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

 

6. Disclaimer of Warranties

6.1. The App is provided "as is" and "as available" without any representations or warranties of any kind, express or implied. BRICK does not warrant that the App will be error-free or uninterrupted, or that defects will be corrected.

 

7. Limitation of Liability

7.1. In no event shall BRICK be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from

(i) your access to or use of or inability to access or use the App;

(ii) any conduct or content of any third party on the App; or

(iii) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

 

8. Governing Law

8.1. These Terms shall be governed by and construed in accordance with the laws of [Your Country], without regard to its conflict of law provisions.

 

9. Changes to Terms

9.1. BRICK reserves the right to update or modify these Terms at any time without prior notice. Your continued use of the App after any such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically for any changes.

 

10. Prohibited Conduct

10.1 Users of BRICK ("the App") are expected to conduct themselves in a respectful and appropriate manner at all times. Prohibited conduct includes, but is not limited to, the following:Harassment and BullyingHate SpeechInappropriate ContentUnauthorized ActivitiesImpersonationSpammingIllegal ActivitiesViolation of PrivacyDisruption of ServiceViolation of Terms

10.2 Violation of any of these prohibitions may result in the immediate termination of your account and/or legal action. BRICK reserves the right to remove any content and take any other appropriate action in response to prohibited conduct on the App.

 

11. DMCA Compliance

11.1 BRICK respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), we have adopted the following policy regarding copyright infringement:

11. 2 Notice of Infringement: If you believe that your copyrighted work has been infringed upon or that your intellectual property rights have been violated, please notify us by providing the following information to our designated copyright agent:A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material.Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an email address.A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

11. 3 Counter-Notice: If you believe that your content was removed or disabled by mistake or as a result of misidentification, you may submit a counter-notification. To file a counter-notification, please provide our designated copyright agent with the following information:Your physical or electronic signature.Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which the address is located (or if you are located outside of the United States, that you consent to jurisdiction of any judicial district in which BRICK may be found), and that you will accept service of process from the person who provided notification under DMCA 512 subsection (c)(1)(c) or an agent of such person.11. 4 Repeat Infringers: BRICK reserves the right to terminate the accounts of users who are repeat infringers of copyright.By using the App, you acknowledge and agree to comply with the DMCA policy outlined in these Terms of Service. Failure to comply with this policy may result in the termination of your account and other legal consequences.
